Welcome to Robooter (“Robooter”, “we”, “us”, or “our”). These Terms of Service (the “Terms” or the “Agreement”) govern your access to and use of our websites, including www.robooter.us and any other online properties that link to these Terms (collectively, the “Site”), as well as the services we provide through the Site (collectively, the “Services”).
By visiting our Site and/or purchasing something from us, you engage in our Services and agree to be bound by these Terms, including any additional terms, conditions, and policies referenced herein and/or available by hyperlink (such as our Privacy Policy, Shipping Policy, Return Policy, Warranty Policy and Cookie Policy).

Please read these Terms carefully before accessing or using the Site. If you do not agree to all of the Terms, you may not be able to browse all or part of information or use the related services on our Site, in this case,you agree to waive our obligation to provide you with the information or services.

We may limit or cancel quantities purchased per person, per household, per account, or per order, including orders that appear to be placed by dealers, resellers, or distributors.

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the Site is inaccurate at any time, including after you have submitted your order.
We are not obligated to honor orders that are based on obvious errors or inaccuracies in pricing or availability.

Risk of loss and title for products pass to you upon delivery to the shipping address you provide, as indicated by the carrier’s tracking information, unless otherwise stated in our Shipping Policy.

Our Site may provide information about power wheelchairs, mobility devices, and related products, including product descriptions, technical specifications, and usage guidelines.

  • Information on the Site is provided for general informational purposes only and does not constitute medical, health, or professional advice;
  • Robooter does not provide medical diagnoses, treatment recommendations, or clinical guidance;
  • You should consult with a qualified healthcare professional to determine whether any Robooter product is appropriate for your individual medical or mobility needs.
Use of our products without proper assessment or training may pose risks. Always review the user manual, safety instructions, and any warnings before using the product.

10. Limited Warranty 

The sale of Robooter-branded products is subject to our Warranty Policy (Limited Warranty), which is incorporated into these Terms by reference.
The Warranty Policy describes:
- The warranty periods that apply to different components;
- What is covered and what is not covered; and
- The process for submitting a warranty claim.
Except as expressly stated in the Warranty Policy and to the maximum extent permitted by law, Robooter disclaims all other warranties, whether express, implied, statutory, or otherwise.

11. Third-Party Services and Links

The Site may contain links to third-party websites, services, or resources that are not owned or controlled by Robooter. These links are provided for your convenience only.
Robooter is not responsible for the content, policies, or practices of any third-party websites or services and does not endorse or make any representations about them. Your use of third-party websites or services is at your own risk and may be subject to additional terms and conditions imposed by those third parties.

12. User Content (Reviews, Comments, and Submissions)

You may be able to submit reviews, comments, questions, photos, or other content (“User Content”) through the Site or our social media channels.
By submitting User Content, you grant Robooter a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and otherwise exploit such User Content in any media, for any lawful purpose, including marketing and promotional purposes.
You represent and warrant that:
  • You own or control all rights in and to the User Content;
  • The User Content is accurate;
  • The User Content does not violate any applicable laws or infringe the rights of any third party; and
  • You will not submit any content that is unlawful, defamatory, obscene, abusive, or otherwise objectionable.
We reserve the right (but not the obligation) to monitor, edit, or remove User Content at our sole discretion.

In addition to other prohibitions set out in the Terms, you are prohibited from using the Site or its content:

15. Disclaimers

THE SITE, SERVICES, AND ALL INFORMATION, CONTENT, AND PRODUCTS PROVIDED THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, EXCEPT AS EXPRESSLY STATED IN OUR WARRANTY POLICY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROBOOTER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
  • The Site or Services will be uninterrupted, timely, secure, or error-free;
  • Any defects or errors will be corrected; or
  • The results that may be obtained from the use of the Site or Services will be accurate or reliable.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ROBOOTER, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS PURCHASED THROUGH THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL ROBOOTER’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR PRODUCTS EXCEED THE GREATER OF:
  • THE AMOUNT YOU PAID TO ROBOOTER FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM;
  • OR US$1,000.
Some jurisdictions do not allow the exclusion or limitation of certain damages or warranties, so some of the above limitations may not apply to you.

17. Indemnification

You agree to indemnify, defend, and hold harmless Robooter, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or related to:
  • Your use of the Site or Services;
  • Your breach of these Terms or any other policies referenced herein; or
  • Your violation of any law or the rights of any third party.

18. Governing Law and Dispute Resolution

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of laws principles, and the federal laws of the United States, where applicable.

Any dispute arising out of or relating to these Terms or your use of the Site or Services shall be resolved in the United States District Court for the Western District of Washington, D.C., and you hereby consent to the personal jurisdiction and venue of such courts.

19. Entire Agreement; Severability; No Waiver

These Terms, together with any policies or operating rules posted on the Site (including our Privacy Policy, Shipping Policy, Return Policy, Warranty Policy, and Cookie Policy), constitute the entire agreement and understanding between you and Robooter and govern your use of the Site and Services, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written.
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any remaining provisions.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
